I-9/E-Verify Update

On August 18th, The Department of Homeland Security (DHS) issued an update to their July 18th announcement on the extension of the temporary flexibility in rules related to the deferment of the physical examination of documents. The decision was made due to the continued precautions related to the COVID-19 pandemic. The July 18th guidance stated that the temporary allowance of the virtual review of documents would expire on August 19th, 2020. At which point the employer would need to meet with the employees within the next three business days to conduct the physical examination of the documents and update the Form I-9 accordingly. DHS has announced an additional 30-day extension of the temporary flexibility. Employers may continue the virtual review of documents until September 19th, 2020.

The U.S. Immigration and Customs Enforcement (ICE) announced there will be no further extension for employers who have been issued Notices of Inspection (NOI) by ICE during the month of March 2020.
